Terms of Service

These Terms of Service ("Terms") govern your access to and use of Nexframe (the "Service"), operated by JAMDEV LTDA ("Nexframe", "we", "us", or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Nexframe is

Nexframe is a tool for generating thumbnails and icons for Roblox and Fortnite content. Image generation is performed through Google's Gemini API. You provide your own Google Gemini API key ("your key"), and generation runs on your key at Google's cost. Nexframe provides the tool, the interface, and the generation styles; it does not resell Google's API and adds no per-generation markup on top of Google's charges.

2. Eligibility and accounts

You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. If you are under 18, you represent that you have your parent or guardian's permission. You are responsible for the activity under your account and for keeping your login credentials secure.

3. Your API key (BYOK)

• On the website, your key is used only to relay generation requests to Google and is never stored, logged, or persisted by us. It exists in your session and is used to reach Google's API on your behalf.
• On the optional Discord bot, if - and only if - you explicitly opt in by connecting your key, we store your key encrypted at rest so the bot can generate on your behalf. You may remove it at any time with the /desconectar command, which deletes it immediately.
• You are responsible for any charges Google bills to the account associated with your key. Nexframe has no control over and no liability for Google's pricing, billing, availability, or terms.
• You must have the right to use the key you provide and must comply with Google's applicable terms.

4. Subscriptions and one-time purchases

Subscription. Nexframe Pro is a recurring monthly subscription. The current price is shown at checkout. It renews automatically each month until cancelled. Payment is processed by Stripe; we do not receive or store your full card details.

One-time credits. You may purchase individual thumbnail or icon credits ("credits") without a subscription. Credits are added to your account balance, do not expire, and are consumed per generation.

Nexframe Credits subscription. Nexframe Credits is a recurring monthly subscription that gives you a number of thumbnail credits each month, generated on our side with no Gemini key of your own. The levels and their prices are shown at checkout; today they are Starter (40 credits a month, $9.99/month), Plus (100 credits a month, $24.99/month) and Max (200 credits a month, $48.99/month). It renews automatically each month, charging the price of your level to the card you used, until you cancel. One credit is one generated image up to 2K.

Monthly credits reset. When a payment for your plan succeeds, your monthly credits are set to your level's amount. Monthly credits you did not use do not roll over to the next month. Credits you receive in another way (for example from a friend invite) are kept separately, do not expire and are not reset by a renewal.

Promotional first month. A first-month or promotional price applies only to the first payment, as shown at checkout; the regular price of your level applies from the next renewal.

Changing level. You can upgrade at any time: the pro-rated difference is charged immediately and the extra credits are added in proportion to the time left in the period. A downgrade takes effect at your next renewal; until then you keep the credits you already have.

How to cancel. You can cancel at any time from your plan page (in the studio, or at nexframe.art/assinar?plano=creditos). You keep your plan and your remaining monthly credits until the end of the period you already paid for; after that they expire and you are not charged again. If a renewal payment fails, your monthly credits are paused until it is paid, and the plan ends if it is not paid.

Nexframe Credits pack. The pack is a one-time payment of $4.99 for 15 thumbnail credits, generated on our side with no Gemini key of your own. It is not a subscription and never renews. Pack credits do not expire and are not reset by a renewal of any plan; one credit is one generated image up to 2K. If the payment is refunded or charged back, the pack credits you have not used yet are removed from your account.

Promotional pricing. We may offer launch or promotional pricing for a limited time. The regular price is the price that applies outside of any active promotion.

5. Cancellation and refunds

You may cancel your subscription at any time; you keep access until the end of the period you already paid for, and you are not charged again. Because the Service delivers digital goods generated on demand, all sales are final and payments are non-refundable except where required by applicable law, or at our sole discretion. One-time credits are non-refundable. The monthly credits of a Nexframe Credits renewal are non-refundable once they have been added to your account; to avoid the next charge, cancel before the renewal date.

6. Acceptable use

You agree not to use the Service to generate, upload, or distribute content that:

• infringes anyone's intellectual property, or impersonates a real person or brand without right;
• is unlawful, defamatory, harassing, hateful, or promotes violence;
• is sexual content involving minors, or sexualizes minors in any way;
• violates Roblox's, Fortnite's, Google's, Discord's, or Stripe's terms;
• attempts to reverse-engineer, scrape, resell, or circumvent the Service, its generation styles, or its access controls.

We may suspend or terminate access for violations, without refund.

7. Community and the showcase (Discord murals)

The Service includes Discord channels: a read-only showcase and a member community channel.

• Content you post in the community channel is your responsibility and must follow the acceptable-use rules above.
• A thumbnail you generate is only published to the public showcase if you explicitly opt in for that specific image, and only after we approve it. We never publish your generated content publicly without your per-image opt-in.
• By opting an image into the showcase, you grant us a non-exclusive licence to display that image, with a Nexframe watermark, for promotional purposes. You may ask us to remove it.

7a. Partner program

Creators and agencies we accept as partners get a personal link (nexframe.art/?ref=CODE).

• Commission. A partner earns 15% of every payment made by a customer who signs up through their link, for 12 months after that customer signs up. The percentage applies to what the customer actually paid, after discounts and before taxes and payment-processing fees.
• Which link counts. The first valid partner link the customer opened in the 60 days before signing up. A customer who already has an account is not referred by opening a link later.
• Refunds and chargebacks. A refunded or charged-back payment earns no commission. If its commission was already paid, that amount is deducted from the partner's next payout.
• Payouts. Paid automatically each month through Stripe, in Brazilian reais, to the account the partner sets up in Stripe's onboarding, converted at the rate Stripe applied to each customer payment. A commission becomes payable 30 days after the payment. Stripe's payout fees are deducted from the commission (currently R$6.00 for each month with a payout, plus 0.25% and R$0.67 per payout). A payout is made only when the payable balance after those fees is at least R$100; a smaller balance carries over to the next month. Automatic payouts are available only for Stripe accounts based in Brazil. For a partner outside Brazil, commissions keep accruing but are not paid until we agree a payout method with that partner in writing.
• Partners under 18. Payouts go to an adult: the partner's agency or parent or legal guardian, who completes Stripe's onboarding and receives the payouts on the partner's behalf.
• Not allowed. Referring yourself (signing up through your own link or with your own email), bidding on "Nexframe" or misspellings of it in paid search ads, spam, and misleading claims about Nexframe. Commissions earned this way are void.
• Changes. We may change or end the program with 30 days' notice to partners. Commissions earned before the end are still paid under these rules.

7b. Invite a friend

Every account has a personal invite link.

• Free thumbnail reward. A friend who creates a new account through your link can make the free sample thumbnail, under the same limits as everyone else. When they receive it, you get 2 Nexframe Credits, for up to 10 friends a month.
• Purchase reward. That friend gets 10 extra Nexframe Credits on their first paid purchase, and you get 10 Nexframe Credits when that purchase is made, for up to 20 friends a month. Each reward is given at most once per friend.
• Credits only. Rewards are Nexframe Credits, have no cash value and cannot be exchanged, transferred or withdrawn.
• One account per person. Inviting yourself (another account of yours, the same email, or the same device or network) earns nothing.
• Refunds and abuse. If the purchase is refunded or charged back, unspent reward credits are removed on both sides. Abuse, such as fake accounts or spam, voids the rewards.
• Changes. We may change or end this program at any time; credits already received stay in the account.

7c. Discord bonus

Linking your Discord account to your Nexframe account with /link, inside the Nexframe Discord server, adds 3 Nexframe Credits to your account.

• Once per person. One bonus per Nexframe account and one per Discord account, ever. The Discord account must be at least 30 days old.
• Credits only. The bonus has no cash value and cannot be exchanged, transferred or withdrawn.
• Abuse. Fake or shared accounts void the bonus.
• Changes. We may change or end this bonus at any time; credits already received stay in the account.

8. Intellectual property

You own the content you generate, subject to Google's terms for the underlying model and to the rights of any third parties depicted. Nexframe owns the Service itself - its software, interface, generation styles, and brand. These Terms grant you no rights in Nexframe's own intellectual property beyond using the Service as intended.

9. Third-party services

The Service depends on third parties - Google (Gemini), Stripe, Roblox, and Discord - each with its own terms and privacy practices. We are not responsible for their acts, omissions, availability, or changes. Your use of those services is governed by their terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, or that generated content will meet your expectations or perform in any particular way. AI-generated output can be inaccurate or unexpected; you are responsible for reviewing what you publish.

11. Limitation of liability

To the maximum extent permitted by law, JAMDEV LTDA will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or Google API charges. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the claim.

12. Changes

We may update these Terms. Material changes will be reflected by the "Last updated" date and, where appropriate, announced in the Service. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. Any dispute will be subject to the courts of the domicile of JAMDEV LTDA, except where mandatory consumer-protection law provides otherwise.
